1. About these terms

These Terms of Service govern your access to and use of Publisher Audio.

Publisher Audio is operated by Lee Coombs, trading as Please Rewind Network.

By creating an account, purchasing a subscription or using Publisher Audio, you agree to these Terms.

If you use Publisher Audio on behalf of a business, publication or other organisation, you confirm that you have authority to agree to these Terms on its behalf.

2. The Publisher Audio service

Publisher Audio provides tools for publishers and website owners to create and deliver audio versions of written content.

Depending on your plan and configuration, the service may include the Publisher Audio dashboard, hosted audio player, API, SDK, WordPress integration, voice selection, audio generation, storage, delivery and related publishing tools.

We may improve, modify or replace parts of the service over time. We will not deliberately make a material change solely to avoid obligations already owed to you.

3. Accounts

You must provide accurate information when creating and maintaining your Publisher Audio account.

You are responsible for keeping your password, API credentials and other account access information secure.

You must notify us promptly if you believe your account or credentials have been lost, disclosed, compromised or used without permission.

You are responsible for activity carried out through your account or credentials where that activity results from your failure to keep them appropriately secure.

4. Websites and publications

You may only connect websites, publications and domains that you own, control or have authority to manage.

Publisher Audio may validate website or domain information and may reject requests that do not correspond to a website associated with the relevant customer account.

The number of websites you can connect may depend on your subscription plan.

5. Your content

You retain ownership of the articles, written material and other content that you submit to Publisher Audio or make available for processing.

You grant us the limited rights necessary to process that content for the purpose of providing Publisher Audio to you. This includes the ability to process text, generate audio, store generated files and deliver that audio through the service.

This permission lasts only for as long as reasonably necessary to provide the service and meet our legitimate operational or legal requirements.

You are responsible for ensuring that you have the rights and permissions necessary for content you submit or instruct Publisher Audio to process.

6. Generated audio

Publisher Audio allows you to use audio generated through your account in connection with the websites, publications and content that you are authorised to manage, subject to these Terms and any applicable restrictions imposed by the underlying technology providers.

Generated speech may contain pronunciation, emphasis or other synthesis imperfections. You are responsible for reviewing whether generated audio is appropriate for your publication and audience.

You must not use generated audio to impersonate a real person, misrepresent the origin of content or facilitate deceptive, unlawful or harmful activity.

7. API, SDK and integrations

Where your account has access to our API, SDK, WordPress plugin or another integration, you may use those tools to connect your authorised websites and publishing systems to Publisher Audio.

API credentials are confidential. You must not publish them, embed secret credentials in publicly accessible client-side code or knowingly provide them to an unauthorised third party.

We may revoke or replace credentials where reasonably necessary to protect your account, other customers or the service.

You must not bypass or attempt to bypass authentication, account boundaries, usage limits, domain validation or other security controls.

8. Subscription plans and usage

Publisher Audio is offered through subscription plans with different usage allowances and limits.

Plans may also be subject to reasonable technical or content-processing limits shown in the service.

Usage allowances are for the applicable subscription period and do not automatically roll over unless Publisher Audio expressly states otherwise.

You must not create multiple accounts or use other methods for the purpose of circumventing subscription or usage limits.

9. Billing and payment

Subscription payments are processed through Stripe.

By starting a paid subscription, you authorise the applicable recurring subscription charge to be collected using the payment method made available through our payment provider.

Unless stated otherwise during checkout, subscriptions are billed monthly and renew automatically until cancelled.

Prices shown to you during checkout are the prices applicable to that purchase. Any taxes or other charges that must legally be added will be handled as shown during the payment process.

10. Cancellation

You may cancel your Publisher Audio subscription at any time.

Unless we tell you otherwise during the cancellation process, cancellation takes effect at the end of your current paid billing period. You can continue using the paid service until that period ends.

Payments already made are normally non-refundable, except where a refund is required by applicable law or where we expressly agree otherwise.

Cancellation prevents future subscription renewals but does not erase obligations or liabilities that arose before cancellation.

11. Changes to plans and pricing

We may introduce, change or discontinue subscription plans, allowances, features or prices.

Where a change affects an existing paid subscription materially, we will provide appropriate notice where required and will not retrospectively change charges already paid for a completed billing period.

12. Acceptable use

You must use Publisher Audio lawfully and responsibly.

You must not use the service to:

• process content that you do not have the right or authority to use;
• infringe intellectual property, privacy or other legal rights;
• distribute malware or malicious code;
• probe, attack, disrupt or attempt to gain unauthorised access to the service or another customer's account;
• circumvent security, authentication, domain validation or usage controls;
• use automated methods in a manner that creates unreasonable or abusive load on the service;
• use generated audio for fraud, impersonation or deliberately deceptive activity; or
• use Publisher Audio in violation of applicable law.

13. Suspension and termination

We may restrict, suspend or terminate access where reasonably necessary because of serious or repeated breaches of these Terms, unlawful activity, security risks, abuse of the service or failure to pay applicable subscription charges.

Where reasonably practicable, we will try to give you notice and an opportunity to resolve the issue before terminating a paid account, unless immediate action is necessary for security, legal or abuse prevention reasons.

14. Service availability

We aim to provide a reliable service, but Publisher Audio is not guaranteed to be available without interruption or error at all times.

Availability may be affected by maintenance, software changes, internet failures, security incidents or third-party services and infrastructure that Publisher Audio relies on.

We may temporarily suspend parts of the service where reasonably necessary for maintenance, security or operational reasons.

15. Third-party services

Publisher Audio relies on third-party infrastructure and services, including services used for hosting, authentication, payment processing, audio generation and storage.

Those services may occasionally experience outages, changes or limitations outside our reasonable control.

16. Intellectual property

These Terms do not transfer ownership of your content to us.

Publisher Audio, its software, interface, branding, documentation and other materials created by or for Please Rewind Network remain ours or the property of the applicable rights holder.

You may use our integration tools and documentation only as reasonably necessary to use Publisher Audio in accordance with these Terms.

17. Liability

Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability that cannot legally be excluded or restricted.

Subject to those rights and restrictions, Publisher Audio is provided as a publishing technology service and we are not responsible for editorial decisions, statements, claims or other content published by customers.

To the extent permitted by law, we are not responsible for indirect or consequential losses, loss of anticipated profits, loss of business opportunities or losses caused by matters outside our reasonable control.

Customers are responsible for maintaining appropriate copies of important original content and should not treat Publisher Audio as the sole archive for their written material.

19. Changes to these Terms

We may update these Terms when Publisher Audio changes or where changes are required for operational, security or legal reasons.

If a change materially affects an existing paid customer, we will provide reasonable notice where appropriate.

The date at the top of this page shows when these Terms were last updated.

20. Governing law

These Terms are governed by the laws of England and Wales.

Nothing in these Terms removes any mandatory rights or protections that apply to you under applicable law.
